Still the only way the people of the future can play these games on a digital service in like 60 years when they become public domain is if the roms are kept circulated (the carts are unlikely to still be around in another 60 years and Nintendo wouldn’t have copies of their own of those roms).

I could be wrong, but I think Nintendo have a share of rights in these games, if I’m not mistaken you had to forfeit part of your license to Nintendo before you could release to their platform.
Another ridiculous thing is Nintendo shutting down those rom sites that have roms for long out of print games made by companies that went bankrupt decades ago.
Sites like that are just trying to preserve video game history since the remaining carts aren’t going to last forever and these games will never be rereleased on any digital service due to issues with the rights. At least not until they become public domain and by then, the carts might no longer be around.

I’d call it unfair, because I shouldn’t get more legal rights than someone else, just because I have more money than them. but #opinions so whatever. I’m sure just throwing out trademark law would have its own problems.

and the only reason we don’t consider her yet another fan is nothing but special privileges given unfairly to corporations by broken laws ed without our consent.
I wouldn’t call it unfair (but wouldn’t call it just neither), like it or not Hasbro been putting a lot of money in the franchise even when it wasn’t doing great.
Hasbro is a little very draconian with their cease and desist tho. Could definitely improve there. It’s not like fan games will dent their billion dollar franchise the way a big rival corporation could.

friendship is magic is a fan-cartoon of disney’s fantasia,lisa frank, gen 1 mlp, ico the brave little horse, and greek mythology. it’s good because it is a derivative work. the original artists were creative, but sucked at other things. someone saw their awful product and was like “hey, I could actually make that good!” and so faust took her childhood fanfiction to hasbro, and the only reason we don’t consider her yet another fan is nothing but special privileges given unfairly to corporations by broken laws ed without our consent.
so yeah just do like everyone else does, change the names and colors, and pretend you didn’t derive it from anywhere. someone may be able to do something great with your original work someday, but that day is not today.
Been there. You pour out your heart and soul into your personal brainchild, people rarely pay attention; cater to their story-based desires, you’re suddenly a king to them.
My only happy medium between the two would be my first Bleach crossfic. Other than that, the stories that I’ve invested in back then were lucky to get any views/likes…
