My personal take would be that the statement “Trans rights now!” only really needs to be made in situations where trans rights are under threat, insufficient or nonexistent, and I would hope that isn’t the case in Equestria. Therefore it seems more likely that the author is referring to the real world threats trans rights face right now than any in-universe situation.
I’m sympathetic to the opposite viewpoint as well, but I’d lean on the side of caution as having the tag on hopefully filters out some of the chuds fine people with differing opinions on matters of gender identity who’ve been leaving their reasoned opinions under this image.

okay, so, tag semantics quibbling time:
it can generally be assumed that fluttershy is trans in this image.
the definition of mouthpiece specifically calls out that it “Does not apply to the character reacting to situations or circumstances they’re in”.
does fluttershy’s transness qualify as enough of a situation for her to be reacting to, here?
